policies of the obama administration, not just the secretive drone strike but using the right to use it against american citizens. this came up in 2007 when a drone strike killed awlaki and kahne, both u.s. citizens and neither charged with a crime. and we have extra judicial killings by the u.s. government without any judicial review and any right of the citizen to argue his or her case in court. these are very sticky issues. the legal basis for these strikes has been kept a secret by the obama administration. you may remember we had huge fights back in the bush era about the legal memos for enhanced interrogation tactics, the so-called torture memos. ultimately they became public. this is viewed by some as an analogy for that, secret memos upon which huge u.s. government policies, with grave consequences are being made. we got a copy of this memo, which is not the olc memo, the office of legal council memo but a white paper, 16 page white paper that mirrors and tracks it and gives us much more detail about what the legal basis for these strikes are. >> you draw a great analogy with

immigration bill. a copy of president obama's plan has been leaked. illegal immigrants would be allowed to become permanent residents of this country in eight years. marco rubio had this to say. the president bill would be dead on arrival in congress leaving us with unsecured borders and a broken legal immigration system for years to come. stephen moore joins us now from washington, d.c. do you think that the white house plan really does throw a wrench into reaching any kind of bipartisan agreement? >> i think this was a real setback. this is very delicate negotiations. you need to find a way to let more immigrants into this country. you need to have a way where people who have been here to have a path to legalization. it has to be coupled with tougher border security. everyone knows that. for some reason, the president is basically saying, we will not move forward with the border security, but we will with these other elements. i think that is a killer. i think marco rubio is right. dagen: why leak it in the first place? in washington, there is always a reason that things come out. >>

's hard to believe there will be any 11th hour compromise given the testy exchanges between the obama administration and congressional republicans. let's check in with brianna keilar at the white house. any movement at all? >> reporter: as of now, john, i will tell you the differences between the two sides here with the white house and senate democrats on one side and house republicans on the other appear to be insurmountable. the divide remaining at this point on how to avert these $85 billion in across-the-board spending cuts. house republicans would like to see some less arbitrary spending cuts only and democrats and the white house want to see a combination of tax increases and some less arbitrary spending cuts. it's this debate we've gotten so used to and that means that these spending cuts that were put in place in 2011 with the idea they'd never go into effect are expected to go into effect as of friday night. the blame game in full effect in washington and it's getting a little crass. listen. >> we have moved a bill in the house twice. we should not have to move a third bill b
